摘要： 监察体制改革对传统的党纪调查和检察侦查单轨衔接体系进行改造，改造成监察调查和检察侦查双轨并行的结构体系。新的双轨体系在内容构造、运行流程等方面借鉴了传统的单轨体系的内容，符合集中反腐资源、保持调查结构体系完整和提高调查效率的要求。双轨体系中存在重要程序缺失、程序设置不对等、人权保障不理想、检察侦查权行使困难等问题。下一阶段的监察改革应加强协同立法，逐步缩小程序设置冲突，实现监察改革和检察改革协调推进，发挥调查双轨的资源合力。

Abstract:
Supervision system reform has transformed the traditional single track between discipline investigation and criminal investigation into current double track between supervisory investigation and criminal investigation. The double track model originates from traditional single track model and has new character which meets the demand of concentrating resource and improve efficiency of investigating corruption. But there are some serious problems, such as the lack of important procedures, the unequal procedure settings, the unsatisfactory guarantee of human rights, and the difficulty in exercising the procuratorial and investigative power. In the next stage, the supervision reform should strengthen the coordinated legislation, gradually reduce the conflict of procedure setting, realize the coordinated promotion of the reform, and give full play to the resource synergy of the two tracks of investigation.
