摘要:
我国社区管理规约的实践表明,目前民间规范的制定、实施、纠纷解决等环节或多或少地都受到政府部门的影响,形成了政府部门主导民间规范的局面。这带来一系列负面影响,不利于激发民间规范的活力,降低了民间自治的能力,使民间规范处于失灵状态,加剧了社会治理难度。未来要使民间规范在社会治理中充分发挥作用,必须让民间规范的主导权回归到民众手中。民间规范的制定主体、制定机构的人员构成、制定过程中的民众参与、示范文本的功能定位、备案审查方式、民间规范纠纷解决主体是影响民间规范主导权的重要因素。把握好这六项因素,是保障民众主导民间规范的重要途径。

Abstract:
At present, the practice of community management regulations in China shows that the formulation,
implementation, dispute resolution and other aspects of non-governmental norms are affected by public power,
forming a situation in which public power dominates non-governmental norms. This has brought a series of
negative effects, which is not conducive to stimulating the vitality of folk norms, reducing the ability of folk
autonomy, making folk norms in a state of failure, and aggravating the difficulty of social governance. In order
to make folk norms play a full role in social governance, we must return the dominant power of folk norms to the people.
