摘要： 鲍某某案所引发的舆论话语，揭示了大众舆论和执法机构对于强奸罪的共同的刻板印象——只要是恋爱，而且是以婚姻为目的的恋爱，就不可能认定为性侵。其主要是在权力关系的轴线上展开，即成年人和未成年人之间权力关系的不对等，但这一维度存在被僵化理解的危险。权力关系不是静止的，而是流动的。同时需要警惕的是，为了纠正一个不对等的权力关系，可能会陷入另一个不对等的权力关系之中。对结构分析的强调不能忽视能动性，这种二元对立的模式需要得到更深刻的检视。刑法处理性侵问题时，可能永远不得不面对犯罪嫌疑人权利和受害人权利的平衡问题。这种困境很难通过舆论一律的方式来解决。

Abstract: Through the analysis of the public opinion discourse caused by a hot case, using the interdisciplinary method,it reveals that the public opinion and law enforcement personnel share a common stereotype on the rigid understanding of rape. The discourse of public opinion caused by this case is basically only on the axis of power relationship, that is, the power relationship between adults and minors is not equal. This is of course an important dimension, but there is a danger of rigid understanding. Power relations are not solid, but liquid, not static, but ?uid. We need to be vigilant: in order to correct an unequal power relationship, whether to fall into another unequal power relationship. The emphasis on structural analysis can not ignore the agency, and this binary opposition model also needs to be further examined. When criminal law deals with sexual assault, it may always have to face the problem of balancing the rights of suspects and victims. This kind of predicament is dif?cult to solve by the way of unanimous public opinion.
