摘要：
特殊农民群体成员资格认定关涉集体经济组织成员权益的实现，与每一位农民的切身利益息息相关，但其在裁判结果、法律适用、资格认定标准、资格认定主体及村民自治程度等方面均存在显著差异。造成司法裁判差异的根源在于特殊农民群体成员资格认定面临着诉讼主体资格不明、资格认定标准不清、资格认定主体不定以及司法介入限度不一等现实困境。对此，应通过赋予特殊农民群体诉讼主体地位、厘清特殊农民群体成员资格认定标准、确定成员集体为成员资格认定主体以及明确司法介入成员自治的必要限度等举措，以规范特殊农民群体成员资格认定的现实路径，保障特殊农民群体的合法权益。
Abstract:
The membership identifification of special farmer groups is related to the realization of the rightsand interests of collective economic organization members，which is closely related to the vital interests of every farmer,but there are significant differences in judgment result, law application, qualification standard,qualifification recognition subject and villagers autonomy degree.The root cause of the difffferences in judicial judgment lies in the fact that the membership identifification of special farmer groups is facing the real dilemma of unclear qualififications of litigation subject, unclear qualifification standard, uncertain qualifification recognition subject and difffferent limits of judicial intervention.By granting the status of the subject of litigation for special farmer groups, clarifying the qualification standard of special farmer groups, determining the collective membership as qualification recognition subject, and clarifying the necessary limits for judicial intervention in member autonomy, standardizing the realistic path of membership identification of special farmer groups and protecting the legitimate rights and interests of special farmer groups.
