Abstract:

“Preventing the disorderly expansion of capital”contains rich competition philosophy, which is closely related to fair competition. Straightening out the relationship between the government and the market, strengthening the risk resolution ability of the pre-prevention of the digital financial market, and maintaining the order of fair competition are the basic essentials of“preventing the disorderly expansion of capital”in the field of the digital economy. However, from the perspective of practice, the strong institutional inertia of the top-down administrative supervision construction for a long time, the excessive emphasis on the supervision standard of safety ignoring efficiency, the one-way supervision mode and the relatively closed response mechanism have led to the absence of the elements of fair competition in the supervision link of“preventing the disorderly expansion of capital”for a long time, and the prominent regulatory difficulties such as the absence of the market, the disregard of competition, and the separation of departments. In order to realize the orderly expansion of capital, the embedding of competitive elements is essential. The regulatory reform of multi-objective balance, multi-party participation, multi-level integration of means and multi-level guarantee of effects urgently needs to be promoted. The integrated regulation that effectively prevents the disorderly expansion of capital should be established.
