摘要:
“双减”政策为乱象丛生的校外培训市场降温,但只是权宜之策。面对校外培训的种种乱象,依法加强校外培训监管成为社会共识。通过梳理可以发现,当下校外培训监管存在调整对象不周延、监管对象不明确、部门监管权限交叉等问题。为促进学校教育和校外培训良性发展,需要通过专门立法的方式将校外培训纳入法治化框架。立法涉及的三个基础性问题分别是:厘清校外培训的边界,明确立法的调整对象;框定校外培训监管的基本原则,明确相关主体的行为准则;构建全链条监管制度体系,规范校外培训市场有序发展。

Abstract:
The“double reduction”policy
has cooled the chaotic off campus training market, but it is only an expedient
measure. In the face of all kinds of chaos in off campus training, it has
become a social consensus to strengthen the supervision of off campus training
according to law. At present, there are some problems in the supervision of off
campus training. In order to promote the sound development of school education
and off campus training, it is necessary to bring off campus training into the
framework of rule of law through special legislation. Among them, three basic
issues are: to clarify the boundary of off campus training and clarify the
object of legislative adjustment; frame the basic principles of off campus
training supervision and clarify the code of conduct of relevant subjects;
build a full chain regulatory system and promote the orderly development of the
off campus training market.
