摘要：

全民所有自然资源资产损害赔偿迥异于生态环境损害赔偿，然而在当下的司法实践中，却呈现出通过生态环境损害赔偿诉讼或环境民事公益诉讼对其进行替代的现象。这种做法从根本上忽视了自然资源附带的经济利益，使得自然资源资产的经济利益与救济途径间的固有张力难以消弭。明确全民所有自然资源权利间的逻辑、索赔权利人的范围以及与生态环境损害赔偿诉讼等进行界分，是构建全民所有自然资源资产损害赔偿诉讼的逻辑前提。基于委托代理协议，从自然资源资产实物形态、非实物形态和超出委托代理协议三个方面展开探索，是未来建构我国自然资源资产损害赔偿诉讼制度的应然面向。在此基础上，应将全民所有自然资源资产损害赔偿诉讼定性为私益诉讼，并对适格原告做出序位安排，这是建构该制度的核心要素。

Abstract:

Compensation for damage to natural resource assets owned by the whole people is different from compensation for ecological and environmental damage, but in current judicial practice, there is an attempt to remedy damaged natural resources through ecological environmental damage compensation litigation or environmental civil public interest litigation. This fundamentally ignores the economic benefits attached to natural resources, and makes it difficult to eliminate the inherent tension between the economic benefits of natural resource assets and the means of remedy. It is the logical premise to construct a lawsuit for compensation for damage to natural resource assets owned by the whole people by clarifying the logic of the rights of all natural resources, the scope of claimants, and the demarcation from the lawsuit for compensation for ecological and environmental damage. Based on the principalagent agreement, it is carried out from three aspects: the physical form of natural resource assets, the non-physical form and the excess principal-agent agreement, which is the natural aspect of constructing the litigation system of compensation for natural resource assets in China in the future. On this basis, the core elements of the system are to characterize the lawsuit for compensation for damages to natural resource assets owned by the whole people as a private interest lawsuit and make a priority arrangement for qualified plaintiffs.
