摘要:

数据技术是元宇宙各类应用场景运行的逻辑基础,不同场景所蕴含的区别化的权利类型是场景风险的生成源头,所以规制风险的前提是对元宇宙应用场景的权利类型进行准确界定。元宇宙空间权是场景风险的形成基础,也是将数据赋能转化为数据赋权的重要媒介,更是将元宇宙场景事实层面的技术风险转化为规范层面法权确证的类型依据。当下,元宇宙空间权的法权属性仍需商榷,其并非准物权,也并非以数据权为唯一构成要素的权利束,而是以数据权为基础形成的多元权利“类集合”。基于此,可将元宇宙划分为三大类空间权场景:虚拟房地产场景、知识产权场景及金融交易场景。元宇宙场景风险的刑法规制应当在空间权权属特征的类型化视角下,针对性地探究其风险的应对路径。

Abstract:

Data technology is the logical foundation for the operation of various application scenarios in the metaverse, and the differentiated types of rights contained in different scenarios are the source of scenario risks.Therefore, the prerequisite for regulating risks is to accurately define the types of rights in the metaverse application scenarios. Metaverse space rights are the foundation for the formation of scenario risks, as well as an important medium for transforming data empowerment into data empowerment. They are also the type basis for transforming factual technical risks in metaverse scenarios into normative legal rights confirmation. The legal attribute of the metaverse space right still needs to be discussed, as it is not a quasi real right or a bundle of rights with data rights as the only constituent element, but a diverse set of rights based on data rights. Based on this, the metaverse can be divided into three categories of spatial rights scenarios: virtual real estate scenarios, intellectual property scenarios, and financial transaction scenarios. The criminal law regulation of the risks in the metaverse scenario should explore the corresponding risk response paths from the perspective of typology of spatial ownership characteristics.
