摘要:
根据空间生产理论,以虚拟社会为本质的元宇宙具有空间属性。其中,元宇宙空间犯罪主要包括三种类型:一是传统网络犯罪向元宇宙空间的全面迁移。从技术角度看,所有传统网络犯罪都可以在元宇宙中实施;从刑法角度看,传统网络犯罪向元宇宙空间的迁移必然会产生新的异化与刑事风险。二是具有人身依附性特征的传统犯罪向元宇宙空间的延伸。其中,侵害性羞耻心等精神型人身法益的行为可以在元宇宙空间实施,侵害他人生命身体型和自由型人身法益的行为不能在元宇宙空间实施。三是只能存在于元宇宙空间的新类型犯罪。对元宇宙空间中独立的经济市场秩序以及数字资产权属等法益实施侵害的行为,应归属此类。然而,无论如何,元宇宙仍属“法内之地”,其空间治理不能脱离现实的规则世界,对其犯罪类型的分析是当前刑法研究的着力点。

Abstract:
According to the theory of space production, the metaverse with virtual society as its essence has space attributes. Among them, metaverse space crimes mainly include three types. The first is the comprehensive migration of traditional cyber crimes to metaverse space. From a technical point of view, all traditional cyber crimes can be carried out in the metaverse; from a criminal law point of view, the migration of traditional cyber crimes to the metaverse space will inevitably lead to new alienation and criminal risks. The second is the extension of traditional crimes with characteristics such as personal attachment to the metaverse. Among them, behaviors that violate spiritual personal legal interests such as shame can be carried out in the metaverse; behaviors that infringe on other people’s life, physical and free personal legal interests cannot be carried out in the metaverse. The third is a new type of crime that can only exist in the metaverse. In this regard, criminal acts that infringe on legal interests such as the independent economic market order and digital asset ownership in the metaverse should fall into this category.However, in any case, the metaverse is still a “land within the law”, and its space governance cannot be divorced from the current world of rules. The analysis of its crime types is the focus of current criminal law theory.
