国际法和国内法之间的关系一直是国际法上的重要问题。基于国际法与国内法的规则体系、价值理念与时代发展等客观条件，二者之间的互动处于动态和演进的过程。国际法与国内法的互动表现为二者既相互独立，又相互影响，交替主导互动过程。逆全球化背景下的国际法和国内法互动，开始从由国际法发挥主导作用，转向以国内法的外溢和国际法化为主要模式。二者关系发展和变化的深层原因，可以基于百年未有之大变局的背景，从全球化与逆全球化视角下的主权回归、安全泛化、治理赤字、科技发展等现实趋势出发加以检视。中国基于“一带一路”倡议，以开放态度参与国际法治构建，同时加强涉外法治体系建设，为国内规则与标准的国际化提供开放性平台，顺应国际法与国内法互动的新趋势，有利于推动国际治理机制的平等共益发展。

The relationship between international law and domestic law has always been an important issue. Based on realistic conditions including the system of international and domestic law, the common value, and the development of the times, the interaction between international law and domestic law is in a dynamic and evolutionary process. The interaction between international law and domestic law ismanifested in the mutual influence of the two, and they are both independent of each other and gradually converge, such interaction is reflected in the theory and practice of international law. In the context of the great changes that have not been seen in a century, the underlying reasons for the tilting of the interaction modes need to be examined from globalization and de-globalization perspective of sovereignty, the concept of security, global governance and the development of technology. In the era of “re-globalization”, based on the “Belt and Road” Initiative, China participates in the construction of the international law with an open attitude, strengthens the construction of foreign-related legal systems, provides an open platform for the internationalization of domestic rules and standards, responds to the new trend of interaction between international law and domestic law, and hopes to promote the equitable and beneficial development of international governance mechanisms.
