社会治理中的“主体”问题研究|立体化格局:检察机关参与社会治理之全新面向

Stereoscopic Pattern : The New Aspect of Procuratorate Participating in Social Governance

摘要:

在全面推动国家治理体系和治理能力现代化的背景下,检察机关是参与社会治理的重要主体,虽然现有理论讨论对其功能转向的关注有限,但在实践中检察机关参与社会治理已显现出“立体化”之趋势。具体而言,检察机关最初是以制发检察建议的方式参与社会治理,覆盖面广泛而专业性欠缺,“扁平化”有余而“立体化”不足。随着公益诉讼、企业合规两个抓手的出现,检察机关参与社会治理逐步呈现出专业性和“立体化”的特征,从以制发检察建议为主的全面治理,转向全面治理与以公益诉讼、企业合规为主的专项治理相结合。为了保证检察机关参与社会治理的效果,需要进一步探索检察建议、公益诉讼以及企业合规这三项制度如何更加“立体化”地规范运行。

Abstract:

Under the backdrop of comprehensively promoting the modernization of the national governance system and governance capacity, procuratorate (as an important subject participating in social governance) have achieved certain governance effects in the process of participating in social governance. Although the existing theory is insufficient, it has shown the trend of stereoscopic in practice. Specifically, procuratorate initially participated in social governance by making and issuing procuratorial suggestions, which covered a wide range but lacked professionalism, and had more than “flat” but less “stereoscopic”. With the emergence of public interest litigation and corporate compliance, the participation of procuratorate in social governance has gradually reflected professionalism and “stereoscopic”, from comprehensive governance based on making and issuing procuratorial suggestions to the combination of comprehensive governance and special governance based on public interest litigation and corporate compliance. In order to ensure the effect of procuratorate participating in social governance, it is necessary to further strengthen this “stereoscopic” pattern. Reflection and promotion from the theoretical and practical level is the only way to achieve this goal, and further explore the three systems of procuratorial suggestions, public interest litigation and corporate compliance, how to operate more “ stereoscopic ”.
